Terms of service
These Terms of Service (hereinafter referred to as the Terms) determine the mutual rights, duties, and conditions regarding payment, delivery, withdrawal from the contract, and warranties between the buyer (hereinafter referred to as the Buyer) and the online store www.luxeol.lt, managed by UAB „Eusova Cosmetics“ (company code 306628794, VAT code LT100017830715, registered address Antano Tumėno g. 4, LT-01110 Vilnius, email info@luxeolshop.com) (hereinafter referred to as the Seller).
By purchasing goods, the Buyer confirms that they have read these Terms and agree to abide by them.
1. Conclusion of the Purchase-Sale Contract
1.1. A distance purchase-sale contract between the Buyer and the Seller is considered concluded when the Buyer places an order in the online store, provides the necessary data, and pays for the goods.
1.2. The contract is concluded and executed in accordance with Articles 6.228¹–6.228¹⁰ of the Civil Code of the Republic of Lithuania (CC), regulating consumer contracts and distance selling.
2. Prices, Payment, and Delivery
2.1. All product prices in the online store are indicated in Euros, including VAT.
2.2. The Buyer pays for the goods using the electronic payment methods indicated at the time of ordering.
2.3. Goods are delivered via the method chosen by the Buyer. Delivery terms and prices are indicated at the time of ordering.
2.4. Ownership of the goods passes to the Buyer from the moment of full payment.
3. Right of Withdrawal (Return of Goods)
3.1. Pursuant to Art. 6.228(10) of the Civil Code, the Buyer (consumer) has the right to withdraw from the distance contract without giving a reason within 14 (fourteen) days from the day of receiving the goods.
3.2. Upon the Buyer exercising the right to withdraw, the Seller shall refund the full amount paid, including delivery costs paid by the Buyer (except for additional costs resulting from the Buyer’s choice of a delivery method other than the least expensive standard delivery offered by the Seller). Refunds are made no later than 14 days from the day the Seller received the notice of withdrawal (the Seller may withhold the refund until the goods are returned or the Buyer provides proof that the goods have been sent back).
3.3. Direct costs of returning the goods are borne by the Buyer.
3.4. If the Seller has not properly informed the Buyer about the right of withdrawal, the Buyer may withdraw from the contract within 12 months from the date of the contract.
3.5. To withdraw from the contract, the Buyer may submit a free-form request via email to info@luxeolshop.com or fill out a model withdrawal form (approved by the Minister of Justice of the Republic of Lithuania).
4. Hygiene and Exceptions (Non-Returnable Goods)
4.1. Based on Art. 6.228(10) part 2 of the Civil Code, the right of withdrawal does not apply to sealed goods that have been unsealed after delivery and are unsuitable for return due to health protection or hygiene reasons.
4.2. Cosmetic and personal care products may be returned only if they are unused, and their packaging, protective seals, foils, membranes, or stickers are not damaged.
4.3. The Buyer has the right to inspect the goods as would be allowed in a physical store (without breaching hygienic protection).
4.4. Subjective sensations of the Buyer (e.g., smell, texture, disliked color) after opening/using a hygiene product are not considered a defect granting the right to return a used product.
5. Diminished Value of Goods
5.1. The Buyer is only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.
5.2. If the returned goods are damaged, untidy, or incomplete, the Seller has the right to refuse the return or reduce the refund amount in proportion to the diminished value.
6. Quality and Warranty
6.1. The Seller undertakes to sell goods that are of satisfactory quality and correspond to the description in the order.
6.2. If the goods are defective, the Buyer has the right to rely on the statutory legal guarantee and make a claim regarding defects within 2 (two) years from the delivery date.
6.3. If the goods have a "best before" date or shelf life, claims regarding quality may be made if defects are discovered before this expiry date.
6.4. The Seller has the right to ask the Buyer to provide photos or other evidence of the defective goods.
7. Complaint Handling and Dispute Resolution
7.1. A Buyer who believes their rights have been violated must contact the Seller in writing via email at info@luxeolshop.com no later than within 3 (three) months of the violation, stating their demands.
7.2. The Seller must examine the request free of charge and provide a detailed reasoned response no later than within 14 (fourteen) days.
7.3. If the dispute cannot be resolved amicably, the Buyer has the right to contact the entity for out-of-court consumer dispute resolution – the State Consumer Rights Protection Authority (VVTAT) (address: Goštauto g. 12, Vilnius, email: tarnyba@vvtat.lt, website: www.vvtat.lt) or apply directly to the court.
8. Personal Data Protection
The Buyer's personal data is processed in accordance with the General Data Protection Regulation (GDPR) and the Privacy Policy published on the website.
9. Final Provisions
These Terms may be amended at the discretion of the Seller. Amendments take effect from the moment they are published in the online store and apply only to new contracts. The version of the Terms valid at the time of placing the order applies.
